The Global Trade Compliance Function at FMC is responsible for ensuring FMC’s compliance with all import and export laws and regulations globally. We work cross-functionally and cross-regionally and partner with internal functions such as legal, tax, finance, procurement, logistics and others to create optimized trade compliance and governance processes. Our goal is to build a globally standardized and streamlined trade compliance program that is fit for purpose for FMC. This means a program that is pragmatic, scalable, sustainable, effective, efficient, and addresses all trade compliance needs for FMC globally.  

 

 

The Lead, Global Export Controls and Sanctions is responsible for the continuous development and refinement of FMC’s global export controls and sanctions program in alignment with the global trade compliance vision and strategy to ensure export and sanctions compliance across all regions and business functions. This role reports to the Senior Manager, Global Trade Compliance.

 

Responsibilities:

 

  • Perform risk assessments regarding current sanctions and export controls by region to identify gaps and opportunities across process controls, systems parameters and performance, export controls and sanctions compliance, policy, SOPs, training, governance and audit
  • Create strategic, prioritized action plan to address gaps and opportunities in collaboration with senior management, regional stakeholders and other regional TC leads, striving for global standardization
  • In collaboration with function leaders and relevant stakeholders, execute action plan to continuously close gaps
  • Develop a targeted trade compliance training strategy for functional teams to enhance export control and sanctions competencies in operational business scenarios (samples, intangible exports, deemed exports etc.)
  • Collaborate with legal, finance, tax, and other functions as needed to make relevant trade compliance determinations to protect FMC
  • Develop, maintain, and communicate standards to operational teams via master data or other databases to facilitate compliant business flow
  • Embed process compliance controls via systemic controls, policies, SOPs, training, data management, and automation where possible
  • Design and facilitate internal audits to ensure compliance with regulations and adherence to internal processes; address diversions
  • Test and evaluate system data and settings on a periodic basis to detect and rectify systematic non-compliance
  • Present FMC in front of government agencies during audits or inquiries or potential disclosures
  • Prepare for and lead through potential external audits
  • Participate in annual review and updates to Policies, Standards, SOPs and Import/Export Compliance Manuals
  • Oversee consulting engagements related to trade compliance decisions or findings
  • Identify opportunities for automation/AI across the global trade compliance program
  • Support SAP GTS to be optimally configured to manage screening for restricted parties for FMC
  • Ensure that global export control and sanctions policies, procedures, standards, processes, desk procedures etc. are  documented, mapped, stored, and regularly reviewed to identify opportunities for improvements
  • Create an optimized governance structure for the export control and sanctions program in alignment with the global structure
      • Develop processes and identify tools to allow FMC to determine dual use, license determination and end-use restrictions
      • Develop record retention standards and tools to comply with local/regional/global/FMC requirements and regulatory requirements
  • Develop country-specific guidance to ensure compliant export operations
  • Serve as escalation point for SPL screening blocks

Qualifications:

  • Minimum of 10 -15 years of experience in U.S. export compliance; global experience preferred; import experience a plus
  • In-depth knowledge of U.S. export regulations, including but not limited to BIS, OFAC, Dual Use, Licensing requirements, end-user restrictions
  • Proven experience with managing systemic restricted party list screening, including analyzing hit rates, evaluating matching thresholds, managing white words/lists, evaluating blocks for false positive, and testing system capabilities or short-falls and drive corrective action with IT and other stakeholders
  • Strong analytical skills with the ability to interpret complex regulatory requirements
  • Excellent communication and interpersonal skills, with the ability to collaborate effectively across departments and with external stakeholders
  • Expertise with trade compliance software and systems required to manage trade compliance data; experience with SAP (S4HANA & GTS) strongly preferred
  • Ability to establish strong working relationships with internal stakeholders and service providers/ consultants
  • Proven ability to develop and deliver export controls and sanctions training programs
  • Detail-oriented with strong organizational and problem-solving abilities
  • Ability to work independently and prioritize tasks in a fast-paced environment
  • Preferred:
      • Proficient in delivering engaging and impactful presentations to diverse audiences
      • Agile Experience (Product Owner, Scrum Master, Team Member)
